These Terms & Conditions govern your booking and use of tour, private chauffeur, hotel, and related travel services arranged by Legacy India Tours ("we", "us", "our"). By submitting an enquiry, confirming a booking, or making a payment, you ("the client") agree to be bound by these terms.
This page is provided as a general template and is not a substitute for independent legal advice. Please have it reviewed by a qualified lawyer before relying on it for your business.
1. Bookings & Confirmation
An enquiry submitted through our website or by email/WhatsApp does not constitute a confirmed booking. A booking is confirmed only once we have issued a written proposal, received your written acceptance, and received the applicable deposit or payment as agreed in that proposal. Prices quoted are valid for the period stated in the proposal and may change if not confirmed within that window, due to factors such as hotel availability, seasonal rates, or currency fluctuation.
2. Pricing & Payment
All prices are quoted per the itinerary and inclusions specified in your written proposal. Unless otherwise agreed, a deposit is required to confirm a booking, with the balance due ahead of arrival — exact terms will be set out in your proposal or invoice. Payments can be made via the methods specified on your invoice. Any bank charges, currency conversion fees, or transaction fees are the responsibility of the client.
3. Cancellations & Refunds
Cancellation and refund terms — including applicable fees based on how close to your travel date you cancel — are set out in full in our Cancellation & Refund Policy, which forms part of these Terms & Conditions.
4. Your Responsibilities
- You are responsible for holding a valid passport, visa, and any required travel authorisation for entry into India, and for meeting any health/vaccination requirements applicable to your travel.
- You are responsible for arranging your own travel insurance. We strongly recommend comprehensive cover including medical emergencies, trip cancellation, and lost baggage.
- You agree to provide accurate personal and travel information (names as per passport, contact details, dietary or medical needs) in good time before travel.
- You agree to behave respectfully towards guides, drivers, hotel staff, and local communities, and to follow local laws, customs, and site-specific rules (including dress codes at religious sites).
5. Our Responsibilities
We will use reasonable skill and care in arranging the services described in your itinerary/proposal, and in selecting reputable local partners (hotels, drivers, guides). Where we act as an agent for third-party suppliers (e.g. hotels, airlines, domestic transport providers), the supplier's own terms and conditions will also apply, and our liability in respect of those services is limited to the extent permitted by law.
6. Changes to Itineraries
Occasionally, itineraries may need to change due to circumstances beyond our control — weather, monument closures, local events, safety advisories, or supplier availability. Where possible, we will offer a comparable alternative at no extra cost. Where a change results in additional cost or a reduction in services, we will inform you as soon as reasonably possible.
7. Force Majeure
We are not liable for any failure or delay in performing our obligations caused by circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather, war, civil unrest, epidemic or pandemic, strikes, government action, or transport disruption. In such cases we will work with you in good faith on rescheduling or alternative arrangements.
8. Complaints
If anything during your trip falls short of expectations, please raise it with your guide, driver, or our team as soon as possible so we can try to resolve it while you are still travelling. If you remain unsatisfied after your trip, please write to us at info@legacyindiatours.com within 30 days of your return, and we will investigate and respond.
9. Governing Law
These Terms & Conditions are governed by the laws of India. Any disputes arising from a booking will be subject to the exclusive jurisdiction of the courts of New Delhi, India, unless otherwise required by applicable consumer protection law in your place of residence.
